US Supreme Court Increases Access To Arms, Overrides New York State Law

The US Supreme Court on Thursday declared for the first time that the US Constitution protects an individual’s right to carry a gun in public in self-defense, delivering a historic victory for advocates of access to guns in a country. deeply divided on the issue of violence caused by firearms.

The decision, with a 6-3 split, with conservative judges in the majority and progressive judges in disagreement, overturned New York State’s limits on carrying hidden weapons outside the home. The court found that the law, passed in 1913, violates a person’s right to “keep and bear arms” under the Second Amendment of the United States Constitution.

The ruling, written by Judge Clarence Thomas, states that the Constitution protects “the right of an individual to carry a firearm in self-defense outside the home.”

Thomas adds: “We know of no other constitutional right that an individual can exercise only after demonstrating to government officials the existence of a special need.”

The decision could overturn similar restrictions in other U.S. states and affect other types of state and local firearms restrictions in the country.

The right to arms, loved by many Americans and promised by the country’s founders in the 18th century, is a controversial issue in a nation with a high incidence of gun violence, including several mass attacks. US President Joe Biden, who called gun violence a national disgrace, criticized the decision.

“This decision contradicts both common sense and the Constitution and should deeply upset us,” Biden said. “In the wake of the horrific attacks on Buffalo and Uvalde, as well as the daily acts of gun violence that don’t make the news, we need to do more as a society, not less, to protect our fellow Americans.”
